Back To Blogs List

Movement at the State Attorney General's Office . Álvaro García Ortiz has agreed this Tuesday that the Anticorruption Prosecutor's Office take over the investigation of the Negreira case , a matter that until now was in the hands of the Barcelona Provincial Prosecutor's Office. He has certified this through a decree in which he establishes that the competence to clarify the facts will pass to the Prosecutor's Office specialized in the fight against corruption and criminality. The Public Ministry justifies the change because it believes that these are crimes of "special importance" .

The head of the Anti-Corruption Prosecutor's Office, Alejandro Luzón , will be in charge of deciding the person responsible for the public prosecution, who will be one of the delegates from Barcelona. Luzon had been pursuing this move for days to declare itself competent for the ongoing investigation. However, since the Provincial Prosecutor's Office of Barcelona had been open for ten months, García Ortiz decided that the priority was to present the complaint and, finally, make the change of Prosecutor's Office.

The Provincial Prosecutor's Office of Barcelona presented a complaint against FC Barcelona last Friday for a continuing crime of corruption in business in the sports field, disloyal administration, misappropriation as well as forgery in commercial documents. According to the complaint, the club paid 7.3 million euros between 2011 and 2018 to ex-arbitration director José María Enríquez Negreira to "favor" Barcelona's interests in arbitration decisions. Through these millionaire payments that are not justified, the provisional conclusion of the Prosecutor's Office is that Barça tried to adulterate the competition by ensuring "neutral" arbitrations in the Spanish League. "It was a genuine remuneration not provided for in the club's statutes or approved by the General Assembly. In short, these perceptions had no legal or statutory support", the text pointed out.

Among the defendants are Barça as a legal entity, the former presidents Josep Maria Bartomeu and Sandro Rosell , to whom the Prosecutor's Office attributes crimes of sports corruption and why it has decided that Anticorruption lead the case. The public ministry has requested that the complaint processed be filed with the court of inquiry number 1 in Barcelona, where a complaint by a member of the VAR has already been registered against Negreira and his son, Javier Enríquez.

The Spanish government also puts the horn on it
While waiting for the court to accept the prosecution's complaint, the pieces are moving in the judicial field. This Monday the Spanish government has confirmed that it will take part in the proceedings against Barça and will appear in the case . As the president of the Superior Sports Council (CSD), José Manuel Franco , explained to Telecinco , the State will also present itself "with the greatest force" after following "the logical process".
